Terms of service

InboxesNow is operated by ProficientNow Management Consultancies - FZE (“we”, “us”, “our”). These terms apply to this website at https://inboxesnow.com, the InboxesNow app, and the inboxes and services you buy through it (together, the “service”).

By creating an account or buying anything from us, you agree to these terms. If you are accepting them for a company, you confirm that you can bind that company, and “you” means the company.

We sell pre-warmed Google Workspace inboxes from our own stock. Inboxes are sold by the domain: each domain comes with 3 inboxes. Every inbox is warmed for at least 21 days before it goes on sale, and each domain’s placement record and warm-up record are shown to you before you buy. Every inbox in stock gets a daily inbox-placement test, sent to seed inboxes at Google Workspace, Outlook and Gmail in the US.

After purchase, you can move inboxes into your own Instantly workspace, which you connect with an Instantly API key, or release a domain to use its inboxes in another sequencer of your choice. Releasing a domain gives you each inbox’s address and password, also as a CSV, and stops our warm-up of those inboxes at the moment of release.

We may change, improve or remove features of the service from time to time. If a change materially reduces what you have paid for, we will tell you in advance where we reasonably can.

To use the service you must:

• be at least 18 years old and use the service for business purposes;
• give us accurate, complete account and billing information, and keep it up to date;
• keep your sign-in details, API keys and inbox credentials secure and confidential.

You are responsible for everything that happens under your account, including actions by anyone you share access with. Tell us straight away at support@inboxesnow.com if you think your account or any credentials have been misused.

The price is $5 per inbox per month, so $15 per domain of 3 inboxes per month, unless a different price is shown to you at checkout. The domain is included and there is no setup fee.

Subscriptions are billed monthly, in advance, through our payment processor, Stripe. Your subscription renews automatically each month, and you authorise us to charge your payment method on each renewal, until you cancel.

Prices exclude taxes unless stated otherwise. Where sales tax, VAT or similar taxes apply, they will be added to your invoice.

If a payment fails, we may retry it and contact you. If it still cannot be collected, we may suspend or end the affected inboxes or your account.

We may change our prices. We will give you notice before a price change applies to an existing subscription, and you can cancel before it takes effect.

You can cancel your subscription at any time. Cancelling stops future renewals. Whether any refund is due is covered by our refund policy. Export any credentials you need before you cancel.

You are responsible for how you use the inboxes, including the lists you send to and the content you send. You must:

• comply with all anti-spam, marketing and privacy laws that apply to your sending, such as CAN-SPAM in the United States, the GDPR and UK GDPR, and CASL in Canada, where applicable;
• have a lawful basis to contact the people you email, and honour opt-out and unsubscribe requests promptly;
• identify yourself honestly and never use false or misleading headers, sender names or subject lines;
• comply with Google’s terms of service and policies for Google Workspace, and with the terms of any sequencer or other tool you connect the inboxes to.

You must not use the service to:

• send phishing, malware, or links to malicious or deceptive sites;
• send content that is illegal, fraudulent, harassing, hateful or that infringes anyone’s rights;
• send to purchased, scraped or harvested lists where that is unlawful;
• impersonate any person or organisation;
• resell or redistribute the service without our written agreement;
• interfere with, probe or attack the service or the systems of others.

We may investigate suspected misuse and may suspend or remove inboxes or accounts involved in abuse, with or without notice.

The service relies on third parties, including Google (Google Workspace), Stripe and, if you connect it, Instantly. Your use of those services is governed by their own terms and privacy policies. We do not control them and are not responsible for their availability, changes, or actions they take on accounts, including suspensions.

When you connect your Instantly workspace, you authorise us to use the API key you provide to deliver your inboxes into it. When you release a domain, you are responsible for keeping its inbox credentials secure and for how the inboxes are used in any other tool.

Warm-up records, including days warmed, warm-up inbox rates, health scores and daily warm-up charts, describe a domain’s past warm-up activity. Placement records, including where test messages landed and whether authentication checks passed, describe the results of our past inbox-placement tests to seed inboxes.

They are provided for information to help you choose. They are not a promise of how the inboxes will perform for your own sending.

Deliverability depends on many things outside our control, including your lists, content, sending volume and the filtering decisions of mailbox providers. We do not guarantee deliverability, inbox placement, open or reply rates, or any business results.

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the service will be uninterrupted or error-free.

You keep all rights to the content you send and the data you bring to the service. You give us permission to process it only as needed to provide the service. How we handle personal data is described in our privacy policy.

The InboxesNow name, website, app and software belong to ProficientNow Management Consultancies - FZE or its licensors. These terms give you the right to use the service while your account is in good standing; they do not transfer any ownership to you.

To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business opportunities, arising out of or related to the service.

To the extent the law allows, our total liability for all claims arising out of or related to the service or these terms is limited to the fees you paid us for the service in the three months before the event that gave rise to the claim.

Nothing in these terms limits liability that cannot be limited under applicable law.

You agree to defend and indemnify ProficientNow Management Consultancies - FZE against claims, losses and costs (including reasonable legal fees) arising from your use of the service, the emails you send, the lists you use, or your breach of these terms or of any law.

We may suspend or end your access to the service, in whole or in part, if you breach these terms, if payment fails, if your use creates a risk for us, our providers or other customers, or if the law requires it. Where reasonable, we will tell you first and give you a chance to fix the problem.

You can stop using the service and close your account at any time. Sections that by their nature should survive termination, including payment obligations, limitation of liability and indemnity, continue to apply.

We may update these terms. If a change is material, we will notify you by email or by a notice on this website before it takes effect. Continuing to use the service after the change takes effect means you accept the updated terms. If you do not agree, you can cancel.

These terms are governed by the laws of the United Arab Emirates. Any dispute goes to the courts of Dubai, United Arab Emirates, unless the law where you live requires otherwise.
